Recent case law increases pressure on Trustees to get it right…

The recent decisions handed down by the Court of Appeal in Futter v Futter and Pitt v Holt signify a fundamental change in the approach to be applied by the courts, in respect of mistakes made by trustees.

Under the so-called ‘Hastings-Bass rule’, the courts sought to protect Trustees by enabling them to set aside the decisions made by them, in the exercise of their discretion, which led to unforeseen and undesirable consequences such as detrimental tax consequences for beneficiaries.
